Modware ("we", "our", or "us") develops and operates the Modware Tech - Parent Control and Modware Tech - Child Guard mobile applications (collectively, the "Apps"). These Apps are designed as parental control tools that allow parents or legal guardians to monitor and manage the digital activity of their children's devices.

This Privacy Policy explains what information we collect, how we use it, and your rights regarding that information.

1. Information We Collect
1.1 Modware Child (installed on the child's device)
  • Location data: Real-time and background GPS location of the child's device, used strictly to allow the verified parent/guardian to locate the device.

  • Phone information: Phone state, call log, and phone numbers configured as authorized contacts. This is used to allow or restrict calls to/from specific contacts.

  • App usage statistics: Information about which applications are used and for how long, to provide usage reports to the parent.

  • Device information: Specific device identifiers (such as FCM tokens or Android IDs) used exclusively to associate the child's device with the parent's account.

  • Notification access: Used solely to manage Do Not Disturb mode when the device is in a locked state. We do not read, process, or store the content of any notifications.

1.2 Modware Parent (installed on the parent's device)
  • Contacts: Access to the device's contact list to facilitate the configuration of authorized phone numbers for the child's device.

  • Account information: Email addresses and authentication credentials used to securely link the parent and child devices.

  • Device configuration: Child device aliases, phone numbers, and schedule settings configured by the parent.

2. How We Use Your Information

All collected information is used exclusively for the following core functionalities:

  • Enabling parents to locate their child's device in real time.

  • Allowing parents to lock or unlock the child's device remotely.

  • Restricting phone calls to parent-approved contacts only.

  • Providing app usage statistics and reports to the parent.

  • Executing scheduled lock/unlock commands.

  • Sending commands between the parent and child devices.

Prohibited Uses of Data:

  • No Advertising or Marketing: We do not use any collected data for advertising, marketing, profiling, or monetization.

  • No AI Training: We strictly prohibit the use of your or your child’s personal data, usage statistics, location data, or any other collected information to train, fine-tune, or improve any artificial intelligence (AI), large language models (LLMs), machine learning algorithms, or automated decision-making systems, whether developed internally by Modware or by third parties.

3. Data Storage and Third-Party Services

We use the following third-party services as data processors to operate the Apps:

  • Google Firebase (Firestore, Authentication, Cloud Messaging, Cloud Functions): Used for secure data storage, user authentication, and real-time communication between parent and child devices. Data is stored securely on Google's servers. See [Firebase Privacy Policy].

  • Google Maps: Used in the parent app to display the child's device location on a map. See [Google Privacy Policy].

  • Google Play Services (Location): Used to obtain the child's device location via Android OS. See [Google Privacy Policy].

Data Sharing Exclusions: We do not sell, trade, or transfer your personal information to any third parties for their own commercial use. We may only disclose data if reasonably necessary to comply with a valid legal process (such as a subpoena or court order), to enforce our Terms of Service, or to protect the safety of users.

4. Data Retention

Data associated with your account is retained only as long as necessary to provide the Apps' functionality:

  • Account Deletion: When you delete your account or explicitly request data deletion, all associated personal data (including child data) is permanently removed from our active servers within 30 days.

  • Location and Usage Data: Location data and usage statistics are not retained indefinitely. They are continually overwritten as new data is collected, retaining only the history necessary for the parent's immediate monitoring needs.

5. Children's Privacy (COPPA Compliance)

The Modware Child app is designed exclusively for use on a minor's device under the direct supervision and verifiable consent of a parent or legal guardian.

Because our service inherently collects personal information from children (such as location and usage data), we rely on the parent or guardian establishing an account and explicitly linking the child's device to provide verifiable consent. We do not knowingly collect personal information from children without this parental consent mechanism in place. If we learn that we have collected personal information from a child without verified parental consent, we will delete that information as quickly as possible.

6. Permissions Explained
  • Location (fine, coarse, background): Track child's device location for parent monitoring.

  • Phone (call, read state, call log): Manage authorized contacts and call restrictions.

  • Contacts (read): Help parent select authorized contacts from address book.

  • Usage statistics: Provide app usage reports to the parent.

  • Notifications: Manage Do Not Disturb mode during device lock.

  • Overlay (system alert window): Display lock screen overlay when device is locked.

  • Accessibility service: Prevent bypassing of parental controls and restrict access to sensitive settings.

  • Device administrator: Prevent unauthorized uninstallation of the child app.

  • Internet / Network: Communicate between parent and child devices via Firebase.

  • Boot completed: Restart monitoring service after device reboot.

7. Security

We take robust measures to protect the information collected through our Apps. All data transmitted between devices and our servers is encrypted using industry-standard TLS/SSL protocols. Authentication is handled through Firebase Authentication to ensure only authorized parents can access their child's data.

8. General Data Rights

Depending on your jurisdiction, you have the right to:

  • Access the personal data we hold about you and your child.

  • Request deletion of your data by using the in-app account deletion tool or contacting us directly. Uninstallation of the app alone does not automatically delete your server data.

  • Withdraw consent at any time by unlinking the child device, disabling permissions, or deleting your account.

9. European Privacy Rights (GDPR & UK GDPR)

If you are a resident of the European Economic Area (EEA), the United Kingdom (UK), or Switzerland, you have specific rights under the General Data Protection Regulation (GDPR) and equivalent laws. Modware acts as the Data Controller for the personal data collected through the Apps.

9.1 Lawful Basis for Processing

We process your and your child's data based on the following legal grounds:

  • Consent: We rely on the explicitly verified consent of the parent or legal guardian to process the child's personal data (e.g., location and app usage data) under GDPR-K provisions.

  • Performance of a Contract: To provide the core parental control services you requested when you created an account and agreed to our Terms of Service.

  • Legitimate Interests: For maintaining the security of the Apps and preventing fraud.

9.2 International Data Transfers

We operate globally and utilize sub-processors like Google Firebase. As a result, your personal data may be transferred to and processed in the United States or other countries outside the EEA/UK. We ensure that such transfers are protected by appropriate legal safeguards, such as Standard Contractual Clauses (SCCs) or the EU-US Data Privacy Framework.

9.3 Expanded GDPR Rights

In addition to the general rights listed in Section 8, you have the right to:

  • Right to Rectification: Request correction of inaccurate or incomplete personal data.

  • Right to Restriction of Processing: Request that we temporarily or permanently restrict the processing of some or all of your personal data.

  • Right to Data Portability: Request a copy of your personal data in a structured, commonly used, and machine-readable format to transmit to another service provider.

  • Right to Object: Object to our processing of your personal data based on legitimate interests.

9.4 Right to Lodge a Complaint

If you believe we have infringed your privacy rights, you have the right to lodge a complaint with your local Data Protection Authority (DPA) within the EEA, or the Information Commissioner's Office (ICO) in the UK.

We may update this Privacy Policy from time to time. If we make material changes, particularly concerning how we handle children's data, we will notify you via email or a prominent in-app notification prior to the change becoming effective.
